Terms of Use

Last updated: 13 October 2026

These terms are the rules for using Bentahay (bentahay.com and app.bentahay.com). Please read them. By making an account, posting a listing, or using co-brokering, you agree to them.

Bentahay is run by Lacrix IT Solutions, registered with the Department of Trade and Industry. In these terms, "we" and "us" means Lacrix IT Solutions. "You" means the person using Bentahay.

1. What Bentahay is - and what it is not

1.1. Bentahay is a website and app. It turns your listing into a web page, shows it to buyers, and passes their inquiries to you. It also gives you tools such as an inbox, automated replies on paid plans, and co-brokering records.

1.2. Bentahay is not a real estate broker. Nobody at Bentahay acts for a buyer, a seller or a broker in a sale. We do not negotiate, and we do not close deals.

1.3. We take no commission. We do not hold, collect, split or pay any commission, and we take no share of any sale. If you pay us, you pay for the plan you chose, and nothing else.

1.4. We are not a party to your deals. Any sale, lease or co-brokering agreement is between the people who signed it. We are not one of them.

1.5. We do not check your listings. The facts on a listing page - price, size, availability, title, photos - come from the person who posted it. We do not confirm them, unless the page says in words that we did.

1.6. What the lines on a listing page mean:

  • The grey line under a brokerage name (for example "Licensed broker - PRC 0012345") shows what the seller told us about themselves. We have not checked it.
  • A green line "Verified on [date]" means the listing broker confirmed that listing's details on that date. It is not a check by us, and it says nothing about a licence.

2. Who can use Bentahay

2.1. You can post listings on Bentahay if you are one of these:

  • a real estate broker with a current PRC licence;
  • a real estate salesperson accredited by the PRC, working under a licensed broker; or
  • an owner selling or renting out your own property.

2.2. Real estate developers must post through a licensed broker.

2.3. If you are a salesperson, you must name the licensed broker who supervises you. Your supervising broker must also sign any co-brokering agreement you sign. Any commission share for you is paid to you only through your supervising broker.

2.4. Tell us the truth about yourself. Your name, your licence number, and your role must be true and current. If your licence expires or is suspended, update your account or stop posting. Do not call yourself a broker or salesperson if you are not one.

2.5. Each person signs in with their own email. On a team plan, an owner adds and removes the people on the team. An owner sees everything the brokerage has on Bentahay; an agent sees only the listings given to them and the buyers on those listings. The brokerage stays responsible for what its people do on Bentahay. When an owner removes someone, that person's listings and buyers stay with the brokerage. Do not share your sign-in with anyone.

2.6. You must be at least 18 years old to make an account.

2.7. Buyers do not need an account. If you send an inquiry, only sections 1, 3.4, 6 and 9 to 12 apply to you, and our privacy notice explains what happens to your details.

3. Your listings are your responsibility

3.1. Only post a property you have the right to advertise. That means you own it, or you hold a written authority to sell or lease it from the owner. Philippine law says that when land is sold through an agent, the agent's authority must be in writing, or the sale is void. So keep that written authority, and show it when asked.

3.2. Your listing must be true and lawful. Price, size, location, title status and availability must be right. When something changes, update the listing. When the property is sold or no longer available, mark it or take it down.

3.3. Only upload photos, posters and files you have the right to use.

3.4. Buyer details you receive are personal data. When a buyer's inquiry reaches you, you hold their details too. Use them only to answer that buyer about that property, and follow the Data Privacy Act of 2012 (RA 10173). Do not add them to a mailing list, sell them, or share them, unless the buyer agreed to it themselves.

3.5. You keep ownership of what you upload. You give us permission to store it, show it on your listing pages, and use it to run Bentahay, for as long as the listing is up. Our privacy notice says what we learn from listings and inquiries, and how long we keep things.

4. Things you must not do

Do not:

  • post a false listing, a fake price, or a property that is not really available;
  • post a property you have no authority to advertise;
  • confirm a sale that did not happen, or register a buyer who is not real, including between two accounts that work together;
  • register a buyer on co-brokering without telling that buyer their name will be given to the listing broker;
  • spam, pressure, mislead or harass buyers, or use their details for anything except answering their inquiry;
  • copy listings or buyer details from Bentahay with bots or scripts ("scraping");
  • break into, overload or test the security of Bentahay without our written permission;
  • pretend to be another person or brokerage.

5. Co-brokering

5.1. Co-brokering lets two licensed brokers (or a salesperson with their supervising broker) sign an agreement on Bentahay to share a commission.

5.2. The agreement is between the brokers who sign it. Bentahay is not a party to it. We provide the listing page, the buyer registration record, the inquiry record and the document. We do not hold, collect or pay any money.

5.3. We keep dated records: who registered which buyer and when, who signed and when. We keep them the same way for everyone. We do not change a signed agreement.

5.4. Sales and prices that two brokers from the same brokerage confirm to each other are not counted in any price information we show.

6. Disputes between users

6.1. We do not decide disputes between brokers, or between a broker and a buyer. That includes who introduced a buyer, who is owed a commission, and whether a listing was right.

6.2. If you are in a dispute, you can ask us for the records we hold about that listing and agreement. We send the same records to both sides. We do not add opinions.

6.3. We may give records to a court, the PRC, the National Privacy Commission or another authority when the law requires it.

7. When we may suspend or close an account

7.1. We may suspend or close your account, remove a listing, or stop your access to co-brokering if:

  • (a) your licence details are false, or your licence has expired or been suspended or revoked;
  • (b) our records show you broke co-brokering agreements more than once, or broke one in a serious way;
  • (c) you confirmed a fake sale or registered a fake buyer;
  • (d) you posted a property you have no authority to advertise;
  • (e) you misled, harassed or misused the details of buyers; or
  • (f) you broke section 4 in another way.

7.2. We decide, and we may act at once. We do not have to warn you before we act. We will email you the reason, and you may reply within 7 days to explain or fix it. If you show us we were wrong, we restore it.

7.3. The list in 7.1 gives examples. We may also act for any other serious misuse of Bentahay.

7.4. A suspension can be lifted once the problem is fixed - for example, a renewed licence or a corrected listing.

7.5. What happens to your information. Our privacy notice says what we keep and for how long. If your account is closed, your data is handled the way the privacy notice describes for a deleted account.

7.6. Co-brokering agreements you already signed stay in force between the brokers. Closing an account does not cancel them, and it does not cancel a commission share already earned. Each broker already has their own signed copy. The listing brokerage's copy of the agreement is kept with that brokerage's account, as the privacy notice says.

7.7. If we close a paid account because of fraud, a fake sale or a fake buyer, we do not refund anything. If we close it for another reason, we refund the unused part of the period you paid for.

7.8. You can close your own account at any time by writing to us.

8. Plans and payments

8.1. Bentahay has a free plan and paid plans. What each plan includes, and its price, is shown before you choose it. You pay for the plan you chose.

8.2. The billing period, payment method and renewal are shown when you choose a paid plan. You can cancel at any time. On a monthly plan, you keep your plan until the end of the month you paid for, and that month is not refunded. On a yearly plan, you can ask for the unused part back, as our Refund Policy explains. Your plan ends on the day we send the refund.

8.3. If we change the price of a paid plan, we tell you by email at least 30 days before it applies to you. The new price starts from your next billing period. If you do not want it, you can cancel before then.

8.4. Paid plans have monthly allowances (for example, AI replies to buyers). When you reach the limit, those features pause until the next month or until you add more.

8.5. Free listings for inviting a broker. When a broker you invited has their first listing live and we have checked both licenses, you and they each get 1 more free listing, up to 3 free listings in all. Free listings are part of the free plan. They have no cash value, cannot be sold, exchanged or given to another account, and do not lower the price of any paid plan.

9. Changes to Bentahay

We keep improving Bentahay, so features may change. If we remove something important from a paid plan you are using, we tell you first by email and refund the unused part of the period you paid for.

10. No promises about results, and limits on our responsibility

10.1. Bentahay is provided "as is". We work to keep it running and correct, but we cannot promise it will never be down, slow, or have mistakes.

10.2. We do not promise that you will get inquiries, buyers or sales.

10.3. Automated replies to buyers answer only from what the broker published on the listing. If they are unsure, they say the broker will confirm. The broker is responsible for their listing's facts.

10.4. We are not responsible for what users do: false listings, broken agreements, unpaid commissions, or how a broker treats a buyer.

10.5. As far as the law allows, we are not liable for any loss that comes from using Bentahay.

10.6. If a court still finds us responsible, the most we pay is what you paid us in the 3 months before the loss, or PHP 1,000 if you are on the free plan. This limit does not apply to fraud, because the law does not allow it.

11. Changes to these terms

11.1. We may update these terms. For an important change, we email you and show a notice in the app at least 30 days before it applies.

11.2. If you do not agree, you can stop using Bentahay and close your account before the change applies. If you are on a paid plan, you keep it until the end of the period you already paid for.

11.3. Small fixes - typos, clearer wording that does not change what the terms mean - can be made without notice. The date at the top always shows the last update.

12. The law and where disputes with us go

12.1. These terms are governed by the laws of the Philippines.

12.2. If you and we disagree, please email us first. We will reply within 7 days and try to settle it.

12.3. If it is not settled, any case between you and us shall be filed exclusively in the proper courts of Makati City, the parties waiving any other venue. Where the law requires barangay conciliation first, it will be followed.
